This Privacy Policy (“Policy”) incorporates the manner in which the information of a Data Principal/User/Visitor/Subscriber (“User”) who has provided any personal information to this website, is being collected, disclosed, transferred, and protected by the E-Sampatti and further the rights and duties of the fiduciary, the user, and the third party responsible for handling the data. The Policy uses “her” as a gender-neutral pronoun.

This Policy will be read as a part and parcel of the Terms of Use and other terms or policies on this website (“E-Sampatti”). The Policy will be effective from the date and time, wherein the user registers herself by assenting to the Policy and the terms of use, with the E-Sampatti. The user needs to carefully read the Policy and the terms of use before opting for our services.

The E-Sampatti holds utmost caution and care while handling the data of its users and is committed to protecting the same. The E-Sampatti collects two types of information: the information given by the user and the information that is tracked automatically during the navigation by the user on the E-Sampatti website.

The user, while using the services provided by the E-Sampatti, consents to the collection, storage, use, transfer, sharing, and distribution of the data, exclusively for the purpose of the services opted by her.

1. Information processed by the E-Sampatti

• Information received from the user
  • The user, while registering or making any contact with the E-Sampatti for its services, provides the necessary information for such a specific purpose. This includes basic information such as name, gender, age, address, pin code, email, phone number, interests, etc.
• Subscription/Paid Services data
  • While opting for any paid services of the E-Sampatti, we or our payment gateway partner will collect the user’s information for purchase, such as billing information, address, credit/debit card number, expiration date, UPI details, etc.
• Information received when the user opts for the services
  • Any information and relevant documents in addition to the above-noted information collected by E-Sampatti shall be kept safely and with utmost care and caution, and shall only be processed for the purpose of that specific service opted by the user.
• Other information provided voluntarily
  • The E-Sampatti may collect such additional information provided voluntarily, including but not limited to when the user provides feedback, comments, changes in email preferences or content, survey, or any communication between the user and E-Sampatti.

2. Utilization of data provided by the User

• For a specific purpose
  • The data provided by the user while registering with E-Sampatti or in any other manner for other services shall only be used and utilized for that specific purpose for which the consent has been provided by the user. Any processing of such data for purposes other than the specified purpose for which the consent is provided shall only be made after obtaining the consent of the user for such other specific purposes.
• For Commercial and marketing communication
  • The E-Sampatti may use the email address or other personally identifiable information to send commercial or marketing messages about the updates and additional features pertaining to E-Sampatti and the services opted by the user. All such communications, excluding the communication for the specific purpose, shall only be communicated to the user who has opted for such a facility.
• For Non-commercial or administrative purposes
  • The email address of the user provided during registration on E-Sampatti or in any other way may be used for purposes such as notification for website changes, customer services, billing, etc.
• Personal information of the user essential for basic functions and features
  • The personal information provided by the user will allow her to log in to the account at E-Sampatti. It will further be utilized for resolving issues and queries and answering the enquiries and grievances.
• Where consent is not provided for commercial and marketing communications
  • Where the user does not opt for such services or does not provide necessary data such as personally identifiable information, the E-Sampatti may not be able to provide certain services. Further, in such cases, the E-sampatti will not be liable or responsible for the denial of certain services.

The E-Sampatti from time to time contacts the user for updating personal information so as to provide such features that the E-Sampatti believes may benefit or interest the user.

3. Sharing of user’s information with any third party without obtaining prior consent of the user shall only be made in the following limited circumstances:

• Necessary for specific purposes
  • The E-Sampatti proposes to share such information of the user as necessary for specific purposes, with the offices and employees of the E-Sampatti and for the purpose of processing such personal information on its behalf. The E-Sampatti ensures that such information of the user will only be processed under the instruction of the user and in compliance with this policy and the Terms, with appropriate confidentiality and security measures.
• Legal purposes
  • The information may be shared for legal purposes for the protection of E-Sampatti and its employees’ rights or where such disclosure is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights, whether intentionally or otherwise, or when anyone could be harmed by such activities.

4. Accessibility and updation of personal information

• Accessibility
  • The user will be provided a summary of all the personal data belonging to such users by the E-Sampatti, as and when such request is made, within a reasonable time.
• Updation
  • The E-Sampatti will also ensure that any such data belonging to the user which is incorrect or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law for legitimate business purposes. The E-Sampatti may ask individual users for their identification and the information requested to be accessed, corrected or removed before processing such requests, and further may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be impractical or for which access is otherwise not required. The updation will be made free of charge, except wherein disproportionate effort is required. After the information of the user is updated, residual copies may take a period of time before it may be detected from the active servers and may remain in the E-Sampatti or Data Processor’s backup system.

5. Security of the Data stored

The E-Sampatti is equipped with a firewall to protect and monitor the outgoing and incoming data. We further use industrial standard security to store the data provided on the E-Sampatti.

6. Updation and changes of Policy

The Policy may be altered from time to time, to incorporate new changes in the technology, applicable law or any other variations. The E-Sampatti reserves the right to change the terms of the policy or the terms of use. Any such changes will only be made effective after duly posting the notification of the new policy on the E-Sampatti website. It is recommended for the user to periodically review the policy. Such updation shall be deemed to be accepted by the user wherein the user visits the website after the notification has been made on the website. The E-Sampatti will also make reasonable efforts to inform the user via email.

7. Miscellaneous

• Data security
  • The E-Sampatti uses commercially reasonable security measures and solutions to protect the loss, misuse, and alteration of the data under the control of E-Sampatti. However, such security measures may not provide absolute guarantees for the protection of any data shared or provided to the E-Sampatti.
• User’s responsibility to maintain confidentiality
  • The user has the responsibility to maintain the secrecy and confidentiality of the password, email address, and other account-related information. The E-Sampatti will not be responsible for any breach arising from the fault of the user to take reasonable precautions or share information with a third party.
• Third-party website
  • The E-Sampatti may contain links to other websites for advertising purposes. Navigation to such a third-party website does not make E-Sampatti liable for misuse of information. Further, the E-Sampatti shall not bear any liability towards the same. The interaction between the user and such a third-party website shall be exclusive between the user and the third party.

Grievance Redressal/Queries and questions

The E-Sampatti grievance redressal mechanism provides a very quick and consumer-centric redressal, wherein each query and concern of the users shall be addressed, which may include but is not restricted to the abuses or concerns with regard to the use, processing, and disclosure of information provided by the user or breach of any policy or the terms of use. The user, for the purpose of grievance redressal, will approach the grievance redressal officer through email at grievance.officer@esampatti.com.
