This terms of use (“Terms”) is a legally binding agreement between the data principal/Visitor/Subscriber (“User”) and the E-Sampatti Solutions Pvt. Ltd. (“E-Sampatti”) for the usage of the website and its services. The privacy policy, rules, guidelines or any other such terms or policies on the E-Sampatti will be considered as a part and parcel of the present Terms. The user’s access to the E-Sampatti or any of its services shall be construed as an assent/agreement to the present Terms, and therefore it is advised to visit the Terms, policies, rules and guidelines or any other such terms or policies as the case may be.
It is to be noted that the Terms including the policies, guidelines, rules or any other such terms are subject to modifications and therefore, it is advised to the user to review the Terms periodically.
The E-Sampatti reserves the right to suspend the operations for the purpose of maintenance, technical upgradation or support of its website and other services and such exercise would be done without intimating the user in advance.
It is to be noted that “user” includes buyer, seller or any visitor on this website and ‘she’ will be used as a gender neutral pronoun for any person, natural or artificial. Further, “services” includes all services provided by the E-Sampatti, i.e. buying, selling and renting the property and other services as mentioned in clause 2(e) of the present Terms.
It is further to be noted that the E-Sampatti deals with the immovable property and thus these terms shall be interpreted and be given meaning accordingly.
It is further to be noted that the E-Sampatti shall have the right to remove the data provided by the user, when such data is against the law, infringing the rights of any person or is bad for public decency and morality.
Any violation of the Terms shall entitle the E-Sampatti to terminate the services and subscription of the user.
1. Terms shall be binding
These terms shall be binding on the user till the user is accessing or availing the E-Sampatti and its services.
2. Services
The E-Sampatti provides following services through its website:
- Posting necessary and specific data provided by the user to sell or rent her property.
- Sharing necessary and specific data of the user to establish a connection between interested users (Such as buyer and seller, tenant and owner) with the consent of the respective users.
- Connecting the user to property agents.
- Providing consultancy services regarding properties.
- Other services such as property’s document verification, inspection, legal report of title, verification from RERA authority, valuation, registration, mutation, certified copies and agreements.
These above noted services could be subscribed or purchased through various payment methods mentioned on the E-Sampatti as per the term mentioned herein.
3. Eligibility
The user hereby covenants that she has attained the age of majority (18 years or above) and is competent to contract. A minor utilizing the services of this website shall only do so under the guidance and supervision of their Parents/legal guardians and under such parent or legal guardian’s registered account.
The registration would be necessary for opting for any services provided by the E-Sampatti.
4. Accuracy, genuineness and reliability of data provided by the user.
The user shall be responsible for the accuracy, genuineness and reliability of the data provided by the user for any of the services of the E-Sampatti, including listing of the property(s) for the purpose of sale and rent.
The E-Sampatti shall not be liable, directly or indirectly, for any fraud, cheating or misrepresentation that may arise because of such inaccurate or false data provided by the user.
5. Subscription fees
- The subscription fees shall be provided on the subscription page.
- The liability for subscription fees shall arise from the date of commencement of such subscription.
- The users accessing the website for buying or renting the property shall be exempted from this part of the Terms.
6. Links for services
Links for services such as Electricity bill payment and Property tax shall be provided on the website for the convenience of the user.
7. Delete account or change or amend or withdraw account information submitted to the E-Sampatti.
The user may delete her account or change account information submitted during registration or withdraw any information directly through the E-Sampatti website at the account information page.
Note: The user cannot change or amend her phone number/E-mail address which is used for registration on E-Sampatti.
Any amount if refundable shall be refunded in accordance with payments and refunds policy.
8. Security
- Any data provided by the user for any of the services on E-Sampatti, including other services, shall be processed and operated with reasonable security measures upholding confidentiality and secrecy of the user, except wherein such revelation is necessary for the specific purpose for which such data is provided or to the authority permitted by law.
- The transactions on E-Sampatti are secured and protected. The payments are made through payment gateways, which is a facility provided by a third party for transactions. E-Sampatti does not store any payment related information shared by the user and such information is directly shared with the respective payment gateways. Such payment gateways are compliant with the rules, regulations and requirements of the various banks and institutions that are associated with it.
- To maintain the secrecy, the user shall take all the measures as required to protect its user identification and password.
- The user shall only use his user identification to access the services of E-Sampatti.
- In the event of unauthorized sharing of user identification or/and security password, the user should immediately inform the E-Sampatti through any of the contact details mentioned on the website. It is to be noted that the user shall be liable for the use of services by any third party till the user notifies the E-Sampatti of such loss.
- The user shall not use any software to automatically extract any information including listing of properties, from the E-Sampatti without obtaining prior consent in writing.
- The E-Sampatti shall not be liable for any fraudulent transaction or deduction of money from the user’s bank account.
9. Rights, obligations and prohibitions of the user.
- The user shall ensure that the data provided by him is accurate, correct and complete.
- The user agrees that the data provided by the user will be subject to the verification process by the E-Sampatti.
- Any and all licenses, permits, consent, approvals and intellectual property as may be required for using the services shall be obtained by the user at his own cost.
- The user shall ensure the compliance of the communications sent by the E-Sampatti.
- The user agrees that she shall be responsible for all the applicable taxes or and such costs as incurred in using the E-Sampatti Services.
- The user shall be responsible for all the information retrieved, stored and transmitted by him.
- The user shall keep her user identification and passwords confidential and secret, to not disclose it to anyone.
- The user shall be responsible for all the activities occurring on her user identification.
- The user agrees that she will immediately notify the E-Sampatti for any unauthorized use or breach of her account.
- The user shall promptly pay for the subscription and services opted by the user from the E-Sampatti.
- The user undertakes that she is above 18 years in age and competent to enter into a contract.
- The user agrees that she is fully aware of the consequences and results of availing the services from the E-Sampatti.
- The user agrees that she will not make any false claim on the E-Sampatti or its services or any third party on behalf of the E-Sampatti.
- The user agrees that she will not use any automated system or software to extract data from the website without written permission from E-Sampatti.
10. Suspension/Termination of account
The E-Sampatti reserves the right to suspend or terminate the user’s account in the following cases:
- For breach of any terms, conditions, guidelines, policies or laws by the user.
- For failure to pay the subscription fees as per the Terms.
- For providing any false or misleading information by the user.
- If the user is found guilty of violating any terms or policies.
- For any action by the user that may affect the reputation or cause harm to the E-Sampatti or any other user.
11. Payment, refund and cancellation policy
The payment for subscription or any service shall be made as per the payment methods available on the E-Sampatti website.
The user agrees that the subscription fees are non-refundable except in cases where E-Sampatti fails to provide the service. Any refund shall be made as per the refunds policy.
The user agrees that the subscription fees are exclusive of any taxes, if applicable.
The user agrees that she will not use the services for any illegal or unauthorized purpose.
12. Miscellaneous
- All rights, title and interest in the services provided by the E-Sampatti shall remain with the E-Sampatti.
- These terms and conditions shall be governed by and construed in accordance with the laws of the respective state and country where E-Sampatti is registered.
- Any dispute arising out of or in connection with the services or these terms and conditions shall be subject to the exclusive jurisdiction of the courts in that region.
The E-Sampatti reserves the right to modify or discontinue the services at any time without any prior notice to the user. The E-Sampatti shall not be liable for any such modification or discontinuance of the services.
These terms constitute the entire agreement between the user and E-Sampatti with respect to the use of the services. Any failure by E-Sampatti to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these terms and the remaining provisions shall continue in full force and effect.
The user agrees that these terms and any other policies or guidelines posted on the E-Sampatti website constitute the complete and exclusive agreement between the user and E-Sampatti regarding the use of the services.
